Acceptance of Terms and Conditions

By accessing and / or using this website, you agree to be bound by the terms and conditions and all policies listed on this website. Birdify reserves the right to change these terms and conditions as the need arises.

Disclaimer

Guarantees and Liabilities

Birdify, the owners and employees of Birdify will not be liable for any damage, loss or liability arising from the use or inability to use this website and the products and content supplied, listed or referred to on the website. Information, ideas and opinions expressed and shared on this website should not be considered as professional advice. When in doubt or if concerned about your pet’s health, please consult a veterinary practitioner.

Should a specific product have a warranty or guarantee, this contract will be between the customer and the manufacturer / company, and not the customer and Bidify. Birdify will pass on the guarantees on our products; however, we cannot be held liable for the product not meeting expectations. Product descriptions and information are provided by our suppliers. While all reasonable attempts will be made to verify this marketing information, we cannot be held liable should it not match the product exactly.

The use of any product bought from this Website is at the purchaser’s own risk. The purchaser / user indemnifies and holds the Provider (Birdify) harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

General

Sales of Products

Placing an item in the shopping basket without completing the purchase cycle does not constitute an order or an agreement of sale between the consumer and Birdify. Should an item not be available from the supplier, Birdify reserves the right to remove the item from the shopping basket. The consumer will be notified of the removal of the product immediately and all reasonable efforts will be made to suggest alternative products a credit voucher or a refund of the product that is not in stock.

Please be advised that orders exceeding 30 kilograms may not be delivered or may be packed in two separate parcels and additional costs may apply. Consumers will be contacted in these cases.

Birdify reserves the right to change content and remove or add products as the need arises. Prices of products are subject to change without notice as suppliers may change prices without notice. While all reasonable effort is made to keep only available products listed, we rely on our suppliers to provide us with up to date information on their product range. Should a product no longer be available from the supplier, we will inform you of this and suggest an alternative product. Should this product be more expensive than the desired product, and if the consumer wishes to purchase the new product, the consumer will be asked to pay in the additional amount should this product be purchased.

Payments and Billing:

Payments are facilitated by a secure payment gateway (Payfast) which accepts credit cards, debit cards, EFT’s, instant EFT’s, Mobicred and Masterpass. PayFast is a leading online payment processing solution in South Africa. They are dedicated to enabling the easy, secure and instant transfer of money through online purchases.

Birdify undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. Birdify cannot be held responsible for security breaches occurring on the users electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

Returns and Refunds Policy:

Only products that are damaged or faulty may be returned. The consumer must immediately notify Birdify in writing about the product and provide a full description of the fault of the product within 2 days of receiving the product by reporting the defect to info@birdify.co.za.

When returning a product please ensure that it is still in its original condition and packaging. After you have notified us, we will communicate the pickup or drop off address. Please allow 7-14 days for us to inspect the damaged goods and to issue your credit voucher/arrange your refund. Should a product be faulty or damaged we will contact the supplier/manufacturer to assess in the issue. Please be advised that we are restricted to the guarantees and warranties, which may mean fixing the item rather than replacement.

Should they find the product to be in 100% working condition, and the fault be attributed to incorrect usage, we will not be able to offer a credit voucher or exchange the product. The cost of returning the product to us / the relevant supplier as well as the return to you (of a non-faulty product) will be charged for or not credited – whichever is applicable in each case.

Exclusions

You may not under any circumstances return the following:

Products that you or any other person has altered, repaired, incorporated, or added to where such alteration, repair, incorporation or addition has not been authorised by Birdify.

Code of Conduct / Privacy / Laws

Birdify website is hosted, controlled and operated in South Africa and is thus governed by South African laws. Birdify will take all reasonable steps to protect the personal information of all customers on the website, information of customers will not be shared or sold to any third party and will be protected at all times. Personal information is defined under the Promotion of Access to Information Act 2 of 2000 (PAIA).

Please be advised that we do not deliver any live animals unless an agreement has been made with management.

General

Delivery will usually take 2-7 working days depending on where you are situated. All parcels are dispatched as soon as all products in you cart are received from suppliers. Delivery takes place during weekdays and office hours. While the couriers usually deliver within the time specified above, these times are estimates and cannot be guaranteed. Birdify and its employees cannot be held liable for delays in delivery times.

Delays in delivery

Should we have stock shortages and not have the requested products we will contact you in order to arrange if you are willing to wait for our suppliers to provide the product in need or to be issued a credit voucher with the delivery of the “in stock” products. Cancellation Policy

The Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”) entitles you to cancel your purchase within 7 days’ notice if the products you have purchased are not delivered within the agreed delivery period as specified in our delivery policies. Some items that are sold so require special delivery dates and need to be considered before the order is placed.

Should you choose to cancel an order which has not been received within our delivery times, items either need to be:

  • not accepted and returned with the courier upon delivery; or
  • if already received, returned to Birdify in their original state.
